Terms and Conditions for Exquisite Air Charter

Unless otherwise specified, the following terms and conditions are applicable

Parties

Charterer: The Exquisite Air Charter customer making/requesting a private flight booking who details are specified on the contract.

Carrier: The private flight aircraft operator who will be operating and is in operational control of the flight for which the Charterer has accepted in accordance with the agreement and terms and conditions of Exquisite Air Charter as detailed in the charter contract and/or on/with the quotation.

Scope

Exquisite Air Charter acts as an intermediary between you (the Charterer) and our network of approved aircraft operators (Carriers). When booking a charter with Exquisite Air Charter, you will be entering into a direct and legally binding relationship with the aircraft operator. Exquisite Air Charter will fully support you (the Charterer) as an intermediary through your initial inquiry, booking request, flight confirmation, flight, and post-flight dealings.

Cancellation Policy

Domestic Flights: Upon acceptance of this quote, a 10% cancellation fee applies. Additionally, a twohour minimum flight time charge will be incurred if the trip is cancelled within 48 hours of proposed departure. Cancellation fees for permits and travel arrangements will be billed at the cost incurred.

International Flights: Upon acceptance of this quote, a 10% cancellation fee applies. Additionally, a twohour minimum flight time charge will be incurred if the trip is cancelled within 72 hours of proposed departure. Cancellation fees for permits and travel arrangements will be billed at the cost incurred.

One Way Flight Itineraries (including multi-leg one-way flights): One-Way flight itineraries incur a 100% cancellation fee from the time of booking. No Shows: A ‘no show’ will be charged the full quoted amount plus any additional costs incurred

Terms and Conditions

This quote is subject to availability and owner approval at the time of booking. Acceptance of Exquisite Air Charter’s quote does not constitute a confirmed booking of the desired flight. As such, Exquisite Air Charter will verify availability and then shall provide a confirmation of the booking. Inquire with your charter coordinator regarding placing an aircraft on hold. No representation is made on whether the aircraft and pertaining information that are presented will exactly meet your requirements.

U.S. Federal Excise Tax is 7.5%, U.S. Domestic Passenger Segment Fees are $4.00 per passenger, per flight segment, international arrival/departure fees are $18.30 per passenger, per flight segment, and Hawaii/Alaska arrival/departure fees are $9.20 per passenger, per segment. Additional charges (if applicable) including, but not limited to, customs, deicing, international operations charges, reposition fees, flight phone use, catering, ramp fees, airport fees, and ground transportation fees are billed as incurred. The customer shall be liable for any and all costs of cleaning, restoring and/or repairing damages, beyond normal wear and tear, to the interior of the aircraft caused by any of your passengers’ use of the aircraft, or otherwise.

Please be advised that Federal Aviation Administration Regulations for Part 135 Operations (air charter) strictly govern the flight hours and duty time of crew members. If your total flight time should exceed ten hours (with two pilots), or your flight crew is retained for more than fourteen hours within a twenty- four hour period, we are required to relieve them with a new crew or duty rest period of a minimum of ten hours. Therefore, additional charges would apply and would be your responsibility.
All aircraft chartered through Exquisite Air Charter, LLC are covered by aviation insurance. Exquisite Air Charter, LLC shall not be liable for any injury, damage, loss, expense, indirect, special, or consequential damages, or other irregularity caused by the defect of any vehicle or conveyance, or the negligence of any company or person engaged in conveying the passenger or carrying out the arrangements for your trip or by accident, delay, flight schedule, change, cancellation, sickness, weather, strikes, war, quarantine, or any similar cause. Our liability shall in any case be limited to the amount paid to us, and any claim shall be adjudicated in and governed by the laws of the state(s) in which we have our principal business location.

In the event of a trip interruption caused by mechanical failure, weather or any other circumstances beyond the control of Exquisite Air Charter, we will make every effort to secure appropriate alternate arrangements on your behalf; however, Exquisite Air Charter will in no way be liable for any costs incurred by the customer as a result of this interruption and additional charges may be assessed for the continuance of an interrupted trip on an alternate aircraft.

Complete, legal, names of all passengers will be required upon trip confirmation. Passengers 18 years and older must show a government issued identification prior to boarding the aircraft. In addition, it is the responsibility of the passengers to be responsible for having in their possession all required travel documents, including passports and visas. Exquisite Air Charter, LLC will gladly assist you in determining the necessary documents for your trip. Please consult with your charter coordinator.
Per FAA regulations, the weights of all passengers must be given prior to departure so that an accurate weight and balance can be calculated.

Itinerary changes are permitted but subject to a price adjustment and therefore will be re-quoted. In addition, itinerary changes are subject to aircraft and crew availability and owner approval at the time that the change is requested.
All balances are due within 15 days. Balances not paid when due are subject to a late payment fee of 15% of the amount due and interest thereafter on the amount due as applicable by law.

Exquisite Air Charter reserves the right to offer alternate destinations or to delay and/or cancel any trip due to unsafe weather and/or operating conditions. temporary flight restrictions, or other unforeseeable circumstances. Exquisite Air Charter also reserves the right to substitute aircraft, with a comparable or better aircraft, due to mechanical difficulties.
